This program will equip participants with the skills to identify and assess risks associated with high stakes workplace investigations, including matters involving senior leadership, systemic misconduct, retaliation, and potential regulatory exposure. Participants will learn how to strategically plan and structure complex investigations, manage sensitive workplace dynamics, and navigate heightened internal and external scrutiny. The session will also focus on best practices for conducting and concluding investigations in a manner that promotes fairness, credibility, and investigative integrity while mitigating legal, reputational, and organizational risk.

Presenters will use a PowerPoint, and the session will be interactive, encouraging participation, questions, and feedback. Program will address the following topics: • Identifying when an investigation becomes “high-stakes,” assessing legal and reputational risk, and defining the appropriate investigative scope • Ensuring investigator independence and determining when to engage outside counsel or external investigators • Planning and conducting complex investigations, including evidence management, documentation practices, and investigative strategy • Interviewing witnesses in sensitive or high-risk matters, including senior leadership and reluctant participants, while applying trauma-informed techniques where appropriate • Making and documenting credibility determinations and investigative findings in a defensible manner • Managing outcomes and organizational risk, including interim measures, corrective action, retaliation prevention, and post-investigation follow-up
