Participants will engage in instructor-led discussion, integrated case analysis, and scenario-based decision-making exercises examining FMLA, ADA, and short-term disability within a broader workforce and organizational risk-management framework. Participants will evaluate how leave and disability decisions can affect staffing, workforce capacity, operational continuity, employee relations, organizational consistency, and legal exposure. Using complex employee scenarios, participants will determine when FMLA, ADA, and short-term disability may apply independently, concurrently, or sequentially and analyze the different purposes, protections, benefits, and employer responsibilities associated with each. Participants will identify critical decision points throughout the leave and disability-management process, including initial requests, changes in employee status, exhaustion of FMLA or disability benefits, requests for additional leave or workplace accommodations, return-to-work decisions, and potential separation. Participants will apply a structured, risk-informed decision-making framework to evaluate available workforce options while balancing compliance obligations with legitimate operational and organizational needs. Scenario exercises will require participants to assess when additional information is necessary, when the ADA interactive process should be initiated or continued, when an employment decision should be paused, and when circumstances warrant consultation with legal counsel. Participants will also evaluate organizational risks associated with inconsistent administration, medical inquiries, documentation, confidentiality, manager communications, accommodation decisions, and return-to-work practices. Particular attention will be given to strengthening coordination among HR, managers, benefits and leave administrators, and organizational leadership so that individual employee situations are not addressed in isolation from broader workforce and operational considerations. The session will conclude with participants applying an integrated framework for leave, disability, accommodation, return-to-work, and potential separation decisions that supports consistent organizational practices, effective workforce planning, operational continuity, appropriate risk management, and informed leadership decision-making.
