Protecting the Workplace from Violence and Minimizing Legal Exposure: This session will begin with a 50-minute presentation discussing how violence in the workplace has reached epidemic proportions. Employers are experiencing workplace bullying, fighting, harassment, stalking, weapons use, and physical violence including death. The potential for violence to and amongst employees has never been greater. But federal and state agencies, and plaintiff lawyers, portray this as a workplace issue – an employer problem – that employers are required to protect against and plan for. And failing to do so results in the exposure for significant liability to employees, outside parties, penalties, and criminal prosecution. Proceeding this presentation, there will be a 40-minute panel comprised of both HR and legal professionals, discussing questions related to their experiences with violence and bullying in workspaces. We will explore the legal risk our organizations face in relation to workplace violence and its prevention. Hear from our panel of legal experts and HR professionals as they examine techniques to minimize the chance of violent acts in our own organizations. When Employees are Impaired: In this session, our panel of HR professionals and attorneys will delve into substance misuse in the workplace. Through their collective experience, our HR professionals will share their methods for early detection and intervention strategies, while fostering a supportive workplace culture. They emphasize the importance of proactive measures such as education, training, and access to employee assistance programs to address substance misuse effectively while promoting employee well-being. In addition, our attorneys will explain the legal complexities surrounding substance misuse; navigating us through relevant laws, regulations, and compliance requirements. From addressing reasonable suspicion to ensuring ADA and FMLA compliance, their guidance will equip us with the tools needed to mitigate legal risks and uphold a safe and legally compliant work environment. Together, the panel empowers attendees with a holistic understanding of substance misuse, bridging HR and legal perspectives to promote a workplace culture that prioritizes both health and legal compliance.
