This course focuses on the reactive side of employee relations, teaching HR practitioners and people leaders how to address workplace issues when employees fail to meet behavioral or performance expectations. Participants will learn the critical distinction between conduct problems ("won't") and performance problems ("can't"), how to build and consistently enforce a Code of Conduct, administer progressive discipline, write legally defensible corrective action documentation, and create meaningful Performance Improvement Plans (PIPs) that support employee success. The course also explores modern challenges such as AI use, social media, remote-work standards, and reasonable suspicion drug testing, while using real employment law cases to demonstrate the legal consequences of inconsistent enforcement and poor documentation. You will exame key legal lessons from McDonald v. Santa Fe Trail Transportation Co., Reeves v. Sanderson Plumbing Products, Harris v. FedEx Corporate Services, and Cotran v. Rollins Hudig Hall International to learn the importance of consistent standards, good-faith processes, and objective documentation. By the end of the course, learners will be equipped to coach managers through difficult employee situations and apply corrective measures ethically, consistently, and defensibly.
