The PoSH Internal Committee Foundation Course begins with an introduction to the objectives of the training, followed by discussions on consent, professional conduct, and setting appropriate workplace boundaries. It moves into an understanding of harassment and sexual harassment at the workplace, covering the various forms—physical, verbal, and non-verbal—and types such as hostile work environment and quid pro quo. The session also clarifies what does not qualify as sexual harassment, using examples and case studies to explain both forms and types. The next module introduces key legal concepts including aggrieved, complainant, respondent, employee, and workplace. It elaborates on the role and functions of the Internal Committee (IC), its powers akin to those of a civil court, and operational guidelines. Issues around confidentiality, its importance, and the challenges in maintaining it are discussed, along with the principles of natural justice and how they apply to IC proceedings. The session covers IC’s powers and limitations, jurisdiction through case studies, and relevant workplace scenarios using the 4Ps framework. In the subsequent module, the course covers timelines as defined under the PoSH Act and outlines complaints that the IC should not register, such as anonymous complaints, sou motu cases, and those unrelated to the workplace or the PoSH Act. The redressal mechanism is then detailed, including registration of complaints, conduct expectations for IC members, and steps of the initial investigation. This continues with documentation practices, conducting conciliation or inquiry with sensitivity, following procedural timelines, offering temporary relief, and upholding natural justice. It includes practical interviewing tips, awareness of unconscious biases, and managing different real-life scenarios such as emotional distress, retaliation, or cases involving police intervention. Participants are trained on drafting inquiry reports, what to include, how to prepare supporting documents, and understanding types and proportionality of recommendations. The course also addresses procedures for virtual hearings, statutory reporting like annual reports, healthy IC practices, and concludes with a question-and-answer session. Every stage of the training includes Do’s and Don’ts as well as soft skills guidance to ensure a balanced and effective learning experience.
