Participants will be able to: • Identify 5 sequential steps in the conflict cycle and role of beliefs and values in contributing to conflict. • Recognize where Negotiation and Mediation processes fall on conflict resolution continuum and compare it to other processes as they relate to the level of formality, coercion being used by or on the disputing parties, the decision-making authority of the disputants to determine an outcome, and the likelihood of a win/win vs win/lose result. • Ascertain 7 stages of the facilitative mediation process that help disputing parties resolve a broad range of conflicts, including those occurring in an organization, workplace, family and community. • Characterize criteria/strategies for determining whether mediation is an appropriate intervention to use for particular cases/disputants. • Prepare disputants to meaningfully participate in mediation. • Differentiate disputing parties’ “needs” from their beliefs about who is right or wrong in the context of a conflict and understand the relevance of this distinction to the parties resolving their conflict in a non-adversarial manner. • Apply 4 major tenets of an interest based (or needs based) conflict resolution style i.e., 1) separate the people from the problem, 2) address parties’ needs vs. demands, 3) invent options for mutual gain and 4) use objective standards to determine a “fair” settlement. • Describe several strategies the mediator may use to help manage the disputing parties' difficult emotions during negotiations. • Compare 3 critical pieces of information about a dispute that a mediator must identify during the disputing parties' negotiations in order to help facilitate the resolution of their conflict. • Understand 9 National Model Standards of Conduct for Mediators as adopted by the American Arbitration Association, the Association for Conflict Resolution Association and the American Bar Association. • Compose disputing parties' negotiated agreements.
